OVERVIEW
Welcome to Les Gens Incompris. “We,” “us,” and “our” refer to Les Gens Incompris. We operate this store and website, including all related content, features, tools, products, and services, to provide you with a curated shopping experience (the “Services”). We are powered by Shopify. These Terms of Service (“Terms”), together with our Refund & Shipping Policy, Privacy Policy, and any other policies referenced here, govern your use of the Services. Please read them carefully, because they include important provisions on warranties, limits on liability, and how disputes are resolved. By accessing or using the Services or placing an order, you agree to be bound by these Terms and those policies. If you do not agree, do not use the Services.

SECTION 1 - ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your place of residence and can form a binding contract, and you consent to any minor dependents using the Services on devices you own or manage. You agree that all information you give us is accurate, current, and complete. You are responsible for your account credentials and all activity on your account. You may not sell, transfer, or share your account.

SECTION 2 - OUR PRODUCTS
We make reasonable efforts to display products accurately, but colors, textures, proportions, and appearance vary with screens, photography, lighting, materials, and production methods.

Print Variations. Our products are intentionally designed and produced with variations in print size, scale, placement, positioning, alignment, texture, distressing, coloration, and other characteristics. These variations are intentional characteristics of the product and are not manufacturing defects. A print may differ from product photographs, mockups, samples, previous production runs, or another item of the same design. By purchasing, you acknowledge and accept that reasonable variations will occur between individual pieces. Such variations do not, by themselves, make an item defective, damaged, or incorrect, or entitle you to a refund, return, exchange, or replacement, except where required by law.

Product descriptions, specifications, availability, and prices may change at any time without notice. We may discontinue products or limit quantities by person, region, or jurisdiction.

SECTION 3 - ORDERS
Placing an order is an offer to purchase. We may accept or decline any order at our discretion, including for suspected fraud, abuse of our policies, pricing errors, or product unavailability. An order is accepted only when we confirm it, and payment must be received and processed first. Products are made to order, and orders cannot be changed or canceled after production starts. If we cancel or do not accept an order, we will try to notify you by email, phone, or billing address. Returns, refunds, and claims are governed solely by our Refund & Shipping Policy. You represent that your purchases are for personal or household use and not for resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged is the price in effect when you place your order and shown in your confirmation. Unless stated otherwise, prices do not include taxes, shipping, handling, customs, or import charges. Promotions may have separate terms that govern in case of conflict with these Terms. You agree to give accurate and current billing, payment, and account information. You represent that (i) the payment information you provide is true and complete, (ii) you are authorized to use the payment method, (iii) your bank or card issuer will honor the charges, and (iv) you will pay all charges at posted prices, including shipping, handling, and applicable taxes.

SECTION 5 - SHIPPING, FULFILLMENT AND DELIVERY
Products may be made, packed, and shipped by independent third-party providers, so we do not control every step of production, handling, or delivery. All processing, shipping, and delivery dates are estimates and are not guaranteed, and a late shipment does not by itself entitle you to a refund or compensation. You are responsible for giving complete and accurate shipping information. To the fullest extent permitted by law, we are not responsible for delay, loss, theft, misdelivery, failed delivery, customs delays, carrier disruption, or other delivery problems caused by carriers, providers, customs authorities, incorrect or incomplete customer information, or events outside our reasonable control. Orders confirmed as delivered to the address you provided are complete. Lost, damaged, and non-delivered shipments are handled only under our Refund & Shipping Policy and may require your cooperation with the carrier’s claims process. Submitting a claim does not guarantee any remedy. Nothing in these Terms limits any consumer right or remedy that cannot legally be excluded.

SECTION 6 - INTELLECTUAL PROPERTY
The Services, including all trademarks, brand names, logos, text, designs, artwork, graphics, images, product designs, video, and audio, and their selection and arrangement, are owned by Les Gens Incompris, its affiliates, or licensors and are protected by US and foreign intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not reproduce, copy, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any of our content or designs, or print or manufacture products using them, without our prior written consent. Nothing in these Terms grants you any license or right in any intellectual property of Les Gens Incompris, Shopify, or any third party, and all rights not expressly granted are reserved. Shopify’s name, logos, and designs are trademarks of Shopify, and other names and marks belong to their owners.

SECTION 7 - OPTIONAL TOOLS
We may give you access to tools offered by third parties, which we do not monitor or control. They are provided “as is” and “as available,” without warranty or endorsement, and to the fullest extent permitted by law we have no liability arising from your use of them. You use them at your own risk and should review the provider’s terms. Any new features we add are also subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to, or embed functionality from, third parties. We are not responsible for examining or evaluating their content, accuracy, practices, or products, and you use them at your own risk. To the fullest extent permitted by law, we are not liable for any harm or damages related to third-party sites or any purchase or use of third-party products or services. Direct complaints about third-party offerings to that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Les Gens Incompris is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Les Gens Incompris. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Les Gens Incompris, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Les Gens Incompris.

SECTION 10 - PRIVACY
Personal information we collect through the Services is subject to our Privacy Policy and, where applicable, Shopify’s privacy policy (https://www.shopify.com/legal/privacy/consumers). Because the Services are hosted by Shopify, Shopify collects and processes personal information about your use of the Services, and information you submit may be transmitted to Shopify and to third parties in other countries. By using the Services, you acknowledge that you have read these policies.

SECTION 11 - FEEDBACK AND REVIEWS
If you submit ideas, suggestions, reviews, photos, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display it in any medium for any purpose, including commercial use and promotion of the Services. You represent that you own or have all necessary rights to your Feedback, that you have disclosed any compensation or incentive you received for it, and that it is truthful, lawful, and does not infringe, defame, or violate any person’s rights. We have no obligation to keep Feedback confidential, pay for it, or respond to it. We may, but need not, monitor, edit, or remove Feedback in our sole discretion. You are solely responsible for your Feedback, and we assume no liability for Feedback posted by you or anyone else.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
The Services may contain typographical errors, inaccuracies, or omissions about products, pricing, promotions, shipping charges, transit times, or availability. We may correct them and may change information or cancel orders because of them at any time, including after an order is placed. If we cancel an order you have already paid for, we will refund you.

SECTION 13 - PROHIBITED USES
You may use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any law or regulation; (c) to infringe our intellectual property or anyone else’s; (d) to harass, abuse, insult, harm, defame, intimidate, or discriminate against any person; (e) to transmit false or misleading information, including false claims about orders, deliveries, or payments; (f) to send spam, junk mail, or unsolicited promotions; (g) to impersonate any person or entity; or (h) in any way that restricts anyone’s use of the Services or may harm or expose to liability Les Gens Incompris, Shopify, or users.

You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, copy, extract, sell, resell, or exploit any part of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext; (e) use any robot, spider, scraper, data-extraction tool, automated process, or AI tool (including agentic AI) to access the Services, except as permitted by Section 14; (f) interfere with or bypass security, authorization, or access controls, including robot exclusion headers; or (g) place orders with the intent of filing unfounded claims or payment disputes. We may suspend, disable, or terminate your account or access, or refuse orders, at any time and without notice if we determine you have violated these Terms.

SECTION 14 - AGENTS
14.1 This section (“Agent Terms”) applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services. “Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on or using a person’s device without direct supervision.
14.2 No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with Section 14.4. No Agent may access, use, or interact with the Services if we have asked it to refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, or interacts with the Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose its name by including “Agent/[agent name]” in the user agent string; (ii) not conceal or obfuscate that any access or interaction is from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or other measures intended to distinguish computer use from human use; (iii) respond truthfully to any question or prompt seeking to determine whether interactions are from a human or a computer; and (iv) not circumvent or avoid any measure intended to block, limit, modify, or control whether and how Agents access the Services.

SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services, in whole or in part, in our sole discretion at any time without notice, and you remain liable for all amounts due up to the date of termination. The following survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Disputes, Privacy, and any provision that by its nature should survive.

SECTION 16 - DISCLAIMER OF WARRANTIES
Information on the Services is provided for general information only. We do not warrant its accuracy, completeness, or usefulness, and you rely on it at your own risk.

EXCEPT AS EXPRESSLY STATED BY LES GENS INCOMPRIS, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THE ABOVE MAY NOT APPLY TO YOU.

SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL LES GENS INCOMPRIS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, REVENUE, SAVINGS, OR DATA, OR REPLACEMENT COSTS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR ANY ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Les Gens Incompris, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, payable to any third party arising out of (1) your breach of these Terms or the documents they incorporate, (2) your violation of any law or third-party right, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, but failure to notify promptly does not relieve you unless you are materially prejudiced. We may control the defense and settlement at your expense, including choice of counsel, but will not settle any claim imposing non-monetary obligations on you without your consent (not unreasonably withheld). You will cooperate in the defense, including by providing relevant documents.

SECTION 19 - SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law and the unenforceable part severed, without affecting the remaining provisions.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any right or provision is not a waiver of it. These Terms, together with our Privacy Policy, Refund & Shipping Policy, and any other policies or rules posted on the site, are the entire agreement between you and us and supersede all prior or contemporaneous agreements, communications, and proposals, written or oral, including prior versions of these Terms. Ambiguities will not be construed against the drafter.

SECTION 21 - ASSIGNMENT
You may not delegate, transfer, or assign these Terms or any rights or obligations under them without our prior written consent, and any attempt is void. We may transfer, assign, or delegate these Terms and our rights and obligations without notice to you.

SECTION 22 - GOVERNING LAW AND DISPUTES
These Terms and any separate agreements under which we provide you Services are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law principles.

Informal resolution first. Before filing any claim, lawsuit, or payment dispute, you agree to contact us at lesgensincompris@gmail.com, describe the problem, and give us at least 30 days to resolve it, except where law prohibits this requirement.

Venue. Subject to applicable law, any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Jackson County, Oregon, and you and Les Gens Incompris consent to their personal jurisdiction and venue.

No class actions. To the fullest extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or member of any class, collective, or representative action.

Consumer rights. If you are a consumer, nothing in this section removes any mandatory consumer protection right you have under the law of your place of residence.

SECTION 24 - CHANGES TO TERMS OF SERVICE
You can review the current Terms on this page at any time. We may update, change, or replace any part of these Terms by posting changes on our website, and it is your responsibility to check periodically. We will give notice of material changes as required by law, and changes take effect on the date stated. Your continued use of the Services after changes are posted is acceptance of them. Changes apply to orders placed after the effective date.
